BUHARIS AFFIDAVIT; WHITHER LIES THE PERJURY
General Buhari (rtd) deposed to an affidavit believing same to be true, that his Statement of Result is with the Nigerian armed forces most importantly the secretary board of the military. The military denied the claim, stating that they did not receive the original certificate nor the Certified True Copy of same in their record.
Looking at these facts, can the general be guilty of perjury?. Before someone can be guilty of perjury there must have been an established evidence that the deponent has indeed lied on oath with the intention of trying to deceive the court knowing fully well within his awareness that he lied and what he indeed deposed to saying it was with the military was not with them. This is the third time that the General will be swearing to this affidavit to contest for the presidential election and the military had not for one time denied that the certificate was not in their record so what stops the deponent from deposing again this time around. Immediately that the military had denied having custody of same, the general defended himself by providing his Statement of Result from his old school.
It is my view that the general had not lied as he had deposed to this affidavit believing same to be true within him that the certificate is with the military. For the fact that he produced his certificate/Stament of Result shows he had nothing to hide about his certificate nor his results.
The General had not lied and as such not guilty of perjury. He had no guilty mind and cannot be punished for an offence he had no mind to commit. We as a country, cannot use the technique of law to punish an innocent citizen on the platform of sentiment.
